DESTINY FARMHOUSE RENTAL AGREEMENT

This Agreement is made between the Owner and the Renter (Booking Party) for temporary use of the property.

1. Strictly Prohibited Activities

The following activities are strictly prohibited on the premises:

  • Consumption or possession of alcohol
  • Use or possession of drugs/narcotics (as per NDPS Act, 1985)
  • Prostitution, Mujra, or immoral activities (as per Immoral Traffic Prevention Act, 1956)
  • Gambling or any illegal activity

Violation will result in:

  • Immediate eviction without refund
  • Forfeiture of security deposit
  • Reporting to local authorities

2. Liability Disclaimer

The Owner shall not be liable for:

  • Injury, death, or accidents
  • Loss or theft of personal belongings
  • Any incident occurring within the premises

All persons enter and use the property entirely at their own risk.

3. Indemnity & Legal Protection

The Renter agrees to:

  • Indemnify and hold harmless the Owner from any claims, damages, losses, or legal proceedings
  • Bear all legal consequences arising out of their use of the premises

4. Responsibility for Guests

  • The Renter is fully responsible for all guests, invitees, and staff.
  • Any misconduct by guests will be treated as misconduct by the Renter.

5. Property Damage Clause

  • Any damage (intentional or accidental) must be fully compensated by the Renter.
  • The Owner’s assessment of the damage cost shall be final and binding.

6. Swimming Pool & Risk Areas

  • Swimming pool usage is strictly at the Renter’s own risk.
  • No lifeguard is provided on the premises.
  • Children must be supervised by adults at all times.
  • The Owner bears no liability for drowning, injuries, or any related incidents.

7. Occupancy & Unauthorized Entry

  • Only the agreed number of persons are permitted on the premises.
  • Unauthorized entry or overcrowding will result in immediate termination of the booking.

8. Police & Legal Compliance

  • The Owner reserves the right to inform police authorities in case of any illegal or suspicious activity.
  • The Renter shall fully cooperate with law enforcement authorities when required.

9. Noise & Public Nuisance

  • Loud music or any form of disturbance is strictly prohibited (as per local nuisance laws).
  • The Renter is responsible for any complaints, penalties, or legal actions arising from such disturbances.

10. Security Deposit

A refundable security deposit is mandatory.

It may be deducted for:

  • Damages to property
  • Violation of rules
  • Extra cleaning charges
  • Overtime usage

11. Fire & Safety Clause

  • No fire hazards, fireworks, or open flames are allowed without prior permission.
  • The Renter is liable for any fire-related damage or injury.

12. Utilities & Infrastructure

  • Misuse of electricity, water, or equipment will incur additional charges.
  • Generator usage (if applicable) will be chargeable.

13. Parking & Vehicles

  • Vehicles are parked on the premises at the Renter’s own risk.
  • The Owner is not liable for theft or damage.

14. CCTV & Monitoring

  • The premises may be under CCTV surveillance.
  • Any attempt to damage or disable surveillance systems will result in legal action.

15. Inspection Rights

  • The Owner or authorized representative may inspect the property at any time.
  • Non-cooperation may lead to cancellation of booking.

16. Check-in / Check-out

  • Strict adherence to check-in and check-out timings is required.
  • Overstay will be charged on an hourly or daily basis.

17. Force Majeure

The Owner shall not be liable for cancellations due to:

  • Natural disasters
  • Government restrictions
  • Unforeseen events beyond control

18. Immediate Termination

The Owner may terminate the booking without refund if:

  • Any illegal activity is detected
  • Terms and conditions are violated
  • Safety concerns arise

19. Jurisdiction Clause

Any disputes shall fall under the jurisdiction of local courts where the property is located.

20. Binding Agreement

  • This document is legally binding upon signing.
  • Digital or WhatsApp confirmation shall also be treated as acceptance of these terms.
